SAN DIEGO (September 8, 2020) – Higgs Fletcher & Mack (HFM) has unveiled a signature Timeline of Construction Remedies, a useful tool for anyone in the real estate or construction industry. The Timeline of Construction Remedies is designed as a go-to resource for professionals to use during the construction process that provides the key deadlines by when many statutory remedies must be exercised.<\/p>\n

The tool was developed by HFM Partner Kirsten Worley, who initially created the timeline to make sure her clients were aware of important deadlines. HFM is now offering the timeline on the Firm\u2019s website as a free downloadable resource at Timeline of Construction Remedies Under California Law<\/a>.<\/p>\n

The comprehensive timeline includes the deadlines that need to be met under California Law to preserve mechanics\u2019 liens, stop notices and bond claims on private and public works. The timeline also includes guidance on appropriate service methods for each step of the process and additional information on both federal projects and Contractor State License Board complaints.\u00a0 According to Worley, the timeline is applicable to all segments of the construction and real estate industry because it thoroughly details the most important deadlines by when many statutory remedies must be exercised.<\/p>\n

\u201cThe COVID-19 pandemic is likely to cause an economic downtown, which means that many sectors of the real estate and construction industry will possibly experience a heightened claims environment,\u201d said Worley. \u201cAll segments of the industry are likely to be tested by the sufficiency of their paperwork and processes, and therefore, I want to make this tool available to anyone who may need guidance in order to comply with California law.\u201d<\/p>\n

Worley also said it will be critical for contractors to be sure that 20-day preliminary notices, mechanics\u2019 liens and other construction claims have been timely served or filed, and for property owners, it will be important to sort through which mechanics\u2019 liens are untimely or invalid, and conserve cash flow accordingly.<\/p>\n

Worley shared further insights in a recent article posted to HFM\u2019s website. In addition to real estate and business litigation and transactional work, Worley\u2019s practice also includes bankruptcy, insolvency and restructuring.<\/p>\n
